1. Acceptance of these Terms

These Terms of Service ("Terms") are an agreement between you and Medivara Clinics ("Medivara," "we," "us," or "our") concerning your access to and use of medivaracare.com, related landing pages, online forms, and content that links to these Terms (collectively, the "Website").

By accessing or using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website. If you use the Website on behalf of an organization, you represent that you have authority to bind that organization.

4. Business, ownership, and franchise information

The Website is not an offer to sell a franchise, business opportunity, security, ownership interest, or financial product, and it is not a solicitation of an offer to buy one. Any such offering may be made only through the required definitive documents, disclosures, approvals, and agreements, and only where lawful.

Availability, eligibility, professional ownership, clinical control, management structure, licensure, supervision, collaboration, payer enrollment, and operating requirements vary by jurisdiction and individual circumstances. The Website may link to or depend on third-party websites, platforms, tools, or services. We do not control and are not responsible for third-party content, availability, security, or privacy practices. A link does not necessarily imply endorsement. 9. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE." MEDIVARA DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

We do not warrant that the Website will be uninterrupted, error-free, secure, or free of harmful components, or that content will be complete or current. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MEDIVARA AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE WEBSITE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THEIR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE WEBSITE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID MEDIVARA, IF ANY, SPECIFICALLY FOR USE OF THE WEBSITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
